Terms of Service

1. Acceptance

By creating an account and using Findig ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and Johannes Tebbert ("Operator", "we", "us").

2. Description of Service

Findig is an inventory and order management tool for Etsy sellers. It connects to the Etsy API using your OAuth credentials to sync orders, track inventory, calculate profits, and support production planning. The Service is directed at businesses and self-employed individuals (B2B); it is not intended for consumers (Verbraucher) as defined in §13 BGB.

3. Beta Status

The Service is currently in beta and is provided free of charge. During beta:

• Features may be added, changed, or removed without notice.
• The Service is provided without any guarantee of uptime, accuracy, or fitness for a particular purpose.
• We may discontinue the beta at any time or transition to a paid model. We will provide at least 14 days' notice before discontinuing the free tier.
• You use the beta Service at your own risk. Do not rely solely on this Service for business-critical inventory decisions without independent verification.

4. Your Responsibilities

• You are responsible for maintaining the security of your account credentials.
• You must comply with Etsy's own Terms of Service when using this integration.
• You must not use the Service for any unlawful purpose or in any way that violates applicable law.
• You are responsible for the accuracy of any data you enter manually (material costs, inventory levels, etc.).
• You must not attempt to reverse-engineer, scrape, or otherwise misuse the Service or Etsy's API through it.

5. Etsy API Access

The Service accesses the Etsy API on your behalf using OAuth tokens you authorize. We act as a data processor for your Etsy shop data. You can revoke access at any time through your Etsy account settings (etsy.com → Apps) or by deleting your account here.

6. Intellectual Property

The Service, including its software, design, and content, remains the property of the Operator. Your data (Etsy orders, inventory figures, material costs) remains your property. By using the Service you grant us a limited license to process your data solely to provide the Service to you.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, server issues, or Etsy API outages may cause temporary unavailability. During the beta period no SLA is offered.

8. Limitation of Liability

To the maximum extent permitted under applicable German law:

• The Service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for inaccurate inventory calculations or profit figures.
• We are not liable for data loss due to technical failure.
• We are not liable for any indirect, incidental, consequential, or lost-profit damages arising from use of the Service.
• Our total liability for any claim arising from the Service is limited to the fees you have paid us in the 12 months preceding the claim (which is €0 during the free beta period).

Nothing in these terms limits our liability for damages caused by wilful misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit), or for personal injury or death.

9. Subscriptions and Payment

The Service is currently free of charge (beta). When paid tiers are introduced, pricing and subscription terms will be published at least 30 days in advance. Existing free users will receive at least 14 days' notice before any paid tier is required to continue using the Service.

10. Suspension and Termination

You may delete your account at any time. We reserve the right to suspend or terminate accounts that:

• Violate these Terms or applicable law;
• Abuse the Service, the Etsy API, or our infrastructure;
• Have been inactive for more than 12 months.

Upon termination, your data will be deleted within 30 days in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms as the Service evolves. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may delete your account before the effective date.

12. Governing Law and Jurisdiction

These Terms are governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Germany, to the extent legally permissible.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
